Last Spring, New York’s legislature passed a groundbreaking bill to make Big Oil pay for climate damages. The Climate Change Superfund Act (S.2129B and A.3351B) would force fossil fuel companies to pay their fair share for climate damages in New York State.
But Governor Hochul refuses to sign the bill to make Big Oil pay, just like she refused to enact congestion pricing and other climate-action policies, despite New Yorkers and the public clearly demanding climate action.

This year, California, Maryland, Massachusetts, New York, and Vermont all considered laws to make Big Oil pay. The bills all create a “climate superfund” to pay the cost of repairing and adapting to climate damages. It’s similar to the federal Superfund law that compels toxic polluters to pay for cleaning up contaminated sites. But of all these states, only Vermont’s law has been enacted so far. Now, New York has a historic opportunity to make polluters pay for the damage they’ve done to our climate and communities.
New Yorkers are already paying billions for climate disasters — $3.5 billion in just the last two years alone — and many other protection and resilience programs are on hold due to a lack of funding. The Climate Change Superfund Act would raise $3 billion a year to fix roads and bridges, upgrade our schools, and make our communities more resilient.
Now, we just need Governor Hochul to sign the bill and make it law!
Big Oil companies have known for decades that their products were destroying our climate. But instead of warning the American people, they spent millions to spread disinformation and lobby against climate action. Why should they be allowed to continue to rake in record profits while we pay the costs?
